2. Scope of policy
As indicated above, this Policy applies to not only our Websites, but also to all physical locations and/or facilities owned or managed by Weavind Online where you may be required to provide Personal Information thereby rendering it capable of processing by us. On our Websites you may see references or links to websites that are owned and/or managed by third parties which third parties are unrelated to Weavind Online (“Third Party Websites”) and which Third Party Websites are specifically excluded from this Policy. These Third-Party Websites have separate and independent terms and conditions and privacy policies applicable to their respective sites, services and or products. These Third Party Websites may follow different practices in the processing and securing of Personal Information and you are strongly advised to read the privacy policy of each Third Party Website you visit before providing Personal Information as we cannot accept any liability should the Third Party Website process your Personal Information in an unlawful manner. Please note that we shall bear no responsibility or liability for the products offered, services rendered, or content and services provided through or by means of any Third Party Websites. We therefore make no warranties or representations whatsoever regarding the products offered or services rendered by any third party or the content or activities of any Third Party Websites which may be accessed or used through or by means of our Websites and/or their associated services.
3. Who is responsible for the processing of Personal Information collected
Subject to obtaining your consent as envisioned in this Policy, the Personal Information which we collect from you, is processed by Weavind Online as defined in this Policy, which shall include Weavind Online employees, contracted third parties or authorized agents. Weavind Online may be required to provide all employees, contracted third parties or authorized agents with access to your Personal Data in order to enable them to carry out their obligations. These employees, contracted third parties or authorized agents are also required to agree to the terms and conditions of this Policy and subscribe to the following minimum conditions:
a) That pursuant to being afforded access to your Personal Data, they will be identified by a unique identifier which will enable Weavind Online to hold them accountable for any unlawful processing of Personal Data;
b) The use of shared identities will only be permitted in certain circumstances where it is deemed suitable;
c) Each such employee, contracted third party or authorized agent shall read this Policy and subscribe to all the terms and conditions set forth herein;
d) Access records will be maintained by Weavind Online in order to investigate instances of breach;
e) Access will only be afforded to employees, contracted third parties or authorized agents to the extent that it is required for them to comply with their obligations vis-à-vis the person or organisation to who the Personal Information relates, as well as Weavind Online itself.
4. How do we process Personal Information
Information may be collected either through or by electronic means, which includes, without limitation, the use of our Websites, electronic mail (e-mail), text, voice, sound or image messages, or through non-electronic means which includes, without limitation, the capturing of Personal Information on hard copy documents.
When using our Websites your Personal Information may be collected either actively where you or your appointed agent provide us with certain Personal Information or inactively where we collect information from you that you have not actively provided. See below for a more detailed discussion.
a) Active Information Collection :
Active information collection refers to instances where we obtain Information from you where you have directly provided us with Information, such as when you submit an enquiry in respect of a specific products or services, or when you subscribe to receiving marketing material from us. When submitting an enquiry through our Websites you will be required to provide us with your Personal Information which Information will be processed by us in order to adequately address and respond to your enquiry. Throughout the use of our Website(s) or pursuant to providing you with the relevant products and/or services, we may request that you provide us with your views and / or opinion in the form of a questionnaire, such information being required to assist us to not only improve our products and services to our customers/members, but also ensure that our customers/members continue to experience products and services that are of exceptional value and quality. Inactive or passive Information collection refers to instances where we collect Information from you which you have not actively provided as contemplated above. By using our Websites, engaging with us or by making use of our products and/or services we will be collecting your “Personal Information” as contemplated by the definition of “Personal Information” in terms of the Protection of Personal Information Act, 2013.
6. What do we do with your information
All Personal Information which may be collected from you, will only be processed in accordance with this Policy or as specifically disclosed to you and/or brought to your attention, at the time you provide the information. We will be entitled to lawfully process your Personal Information and to disclose the same to any employees, contracted third parties or authorised agents or representatives, as well as trade partners to facilitate the procurement of products and / or services which you may have requested. Given that you wish to subscribe to such services, we will, from time to time, send you promotional emails about our products and/or services using the email address which you have provided. 8. Opting out
Please note that we do not wish to collect and/or process any Personal Information from you that you do not want to be so collected and/or processed. In this regard we use our best endeavors to indicate whether requested information is required or optional during any of our engagements with you. To respond to your request or enquiry, we may require information to allow us to verify that you are the person authorized to view the Personal Information you are requesting access to as contemplated in this Policy. We reserve the right to, at our discretion, refuse to allow you access to certain information which, in our view, if provided to you, will compromise another person’s privacy or will violate any applicable law, foreign law, regulation, or directive in respect of which we are obliged to observe and adhere to pursuant to processing Personal Information.
10. Data security
Unfortunately, the transmission of information via the internet is not completely secure. Whilst we have taken all appropriate, reasonable, technical, organizational and reasonable measures to secure the integrity and confidentiality of the Personal Information in our possession, in order to guard against the loss of, damage to or unauthorized destruction of Personal Information and unlawful access to or processing of Personal Information, we do not guarantee that our security system is 100% secure or error-free. Therefore, we do not guarantee the security or accuracy of the information (whether it be Personal Information or not) we collect from you and process in accordance with this Policy.
Any transmission of Personal Information will be solely at your own risk. Once we have received your Personal Information, we will use strict procedures and security features to try to prevent unauthorised access to it. We shall not be held responsible and by accepting the terms and conditions to which this Policy relates, you agree to indemnify us and hold us harmless for any security breaches which may potentially expose the Personal Information in our possession to unauthorized access and or the unlawful processing of such Personal Information by any third party.
11. Place where Personal Information will be kept
All Personal Information provided to us will be stored on our secure servers located in South Africa, however, we may elect to store data at a destination outside of South Africa in which event we will only transfer your Personal Information to facilities or parties outside South Africa where such transfer is compliant with applicable data protection laws and regulations.
12. Changes to this policy and enforcement
Any employee found in breach of the terms and conditions established by this Policy shall be subjected to disciplinary action, which, depending on the extent of the breach may lead to the termination of their employment. Any contracted third party or authorized agent found in breach of this Policy may have their level of access revoked and will enable Weavind Online to seek appropriate relief in terms of its agreement with such party.
